To those of us who do a lot of non-qualifed annuity work, this is big news. To those of you who don't do a lot, it probably comes as a surprise that this is the first PRL on taxable damage cases. </p><p>As many of us know, Allstate has always been the industry leader in Non-Qualified annuity work and has pioneered over the years the use of non-qualifed assignments on environmental cases, wrongful termination, defamation, sexual discrimination and other taxable damage cases. A lot of that work took place under the watchful eye and guidance of then Allstate employee John McColluch, who created a lot of the concepts and programs on taxable cases that many people take for granted. It is no surprise then that IFS getting this private letter ruling occurred a year or so after John left Allstate and went to work for IFS. John now holds the position of Vice President of Market development for EPS, one of the IFS companies, and he co-authored the private letter ruling on structuring taxable damage cases and using a non-qualified assignment to transfer liability for future payments.&nbsp;</p><p>As I've been saying on this blog and my various talks around the country, the single biggest area of opportunity for the structured settlement industry is taxable damage cases. We have done a multitude of podcasts on this issue, largely on molestation cases, which are taxable, environmental cases, wrongful termination and age discrimination and other work place torts and in each case we have extolled the virtue of structuring these awards. Now with this PLR maybe some of the timid sheep of the structured settlement markets who refuse to develop non-qualified annuity contracts and assignments for use in taxable cases will get off the fence and start offering these to broker and attorneys. Really, other then Allstate, Prudential and to a lesser degree Aviva have been working to grow this area and the life markets now need to get off their hands and go after this area of business. I really wish the life markets would stop sitting on their wallets and spend the money to develop products, ideas and markets, or spring for the cost of the PLR's, necessary to grow new annuity concepts and markets. One of those first initiatives of which The Legal Broadcast Network was happy and proud to be part of are the Joe Jamail videos on the topic of structured settlements.

For those of you who don't know who or what NSSTA is, it is The National Structured Settlement Trade Association, the oldest and largest trade organization dedicated to the promotion and use of structured settlement annuity contracts in personal injury settlements or court awards. Over the years the organization has slowly morphed from a totally defense oriented and dominated entity, to one that now could be called moderately centrist as to it's approach to how structured settlement annuities are marketed. 


The fact that NSSTA was able, with the assistance of <a href="http://www.robinyoungandcompany.com" target="_blank">Robin Young of Robin Young & Company of Houston, TX,</a> to get Mr. Jamail to fly to Austin, TX on his own jet, at his own expense and in the middle of his work week, to first address the entire mid winter regional audience and then sit down and do a prolonged interview with LBN host and nationally renown <a href="http://www.murphylaw.com" target="_blank">trial lawyer Rick Kuykendall</a> is amazing enough. <span class="full-image-float-right"><img src="http://www.thesettlementchannel.com/storage/1126280_1.jpg" alt="1126280_1.jpg" title="1126280_1.jpg"/></span> The idea even five years ago that NSSTA would have one of the nations leading trial lawyers and plaintiff attorneys attend and address it's members, receive a standing ovation after his talk and then provide what amounts to a complete endorsement of the use of structured settlements, is almost laughable. The organization was so tightly controlled by defense interests and myopic about the issue of speaking to the end consumer of the product that it would have been considered heresy.

However, over the last five years and as a result of some truely enlightened leadership and adjustments in their approach to plaintiff issues by people such as Randy Dyer, Henry Strong, Jeff Bowers, Chris Diamantis and Peter Arnold we now have two exceptionally fine video's that are about to be pushed out to the entire NSSTA membership, trial lawyer organizations and plaintiffs looking for answers as to whether or not they should structure annuities. The Legal Broadcast Network worked closely with the NSSTA in shooting, editing and now distributing this content, which brings me to my next point.

How can you use these videos in your practice and share them with trial lawyers and plaintiffs?

First, you can find them on the NSSTA home page and you can simply put a link on your web page, embed the link location in an email or other wise provide access to the videos through a point and click system to the NSSTA front page where these reside. You can find the NSSTA copies of the Joe Jamail videos by clicking here.

The second method you can use to share, distribute or view the Joe Jamail videos on structured settlements is to simply use the "Steal Me" feature on the videos I have embedded on this blog post. These run off our professional networking page at Speaking of Settlements, and you can email them to clients, point them to the link, cut and paste them to your own web page or blog or simply view them there. The second video, in which Attorney Joe Jamail talks directly to trial lawyers about structured settlements is here. In this video Mr. Jamail goes to the point of basically telling trial lawyers that if they don't consider a structured settlement and offer it to their clients in almost every case, they are make a huge error and are potentially committing malpractice. This is one of the strongest endorsements of structured settlements you can find anywhere, from an attorney who is considered by his peers nationally to be one of the true legends of the law. If you are a settlement professional and you aren't sharing this video with your clients you are selling you and your clients short.

As anyone who knows me is aware, during the last 5 months I have been actively engaged in several ventures, not the least of which is The Legal Broadcast Network, of which I am now officially the Chairman. In addition to that i've been up to my elbows in three significant multi-litigant cases in which my firm, Wahlstrom &amp; Associates was further developing it's 468b trust product and approach to handling difficult cases. In short it's been one exceptionally busy 5 months and one that caused my blogging and podcasting schedule here on LBN to suffer. </p><p>So you might ask, what exactly have you been doing and what is going on with LBN, Speaking of Settlements, Wahlstrom &amp; Associates, etc?</p><p><a href="http://www.legalbroadcastnetwork.com" target="_blank"><strong>1. The Legal Broadcast Network, aka, LBN</strong></a>, has now been fully funded by our venture capital firm and other investors with the final papers and official documents signed just last week. As you can imagine, the process of reorganizing LBN, bringing in top level managements, building a team of advisors and ramping up our staffing and production is quite a project. The purchase which will be a combination of cash and debt issued by Liberty, a mutual company, is valued at $6.2 billion and will represent the second major purchase by Liberty in the last year. </p><p>This is a deal that makes a great deal of sense in that Liberty is primarily focused on East coast markets and Safeco is a major player in the Rocky Mountain region and Pacific Northwest. Safeco has languished with a low stock market valuation for some time now and this is on it's face a very good deal both for Liberty and for Safeco stockholders. </p><p>In the settlement world it consolidates one more casualty market under the Liberty umbrella and there will be some re-ordering of the settlement firms who handle the account for Safeco i'm sure once this is done. </p><p>This deal does not impact Symetra, the spin off from Safeco that is an independent operating entity and life market that has it's own structured settlement operation.
