Rare moment of agreement with NY Times

As the token Republican over at The Legal Broadcast Network I often have to endure hours of commentary that I don't necessarily agree with, and often a lot of the reporting that we do get is from sources and articles at the NY Times.

Today columnist David Brooks has a great article on the criteria for picking a supreme court justice. I couldn't agree more. You NEVER know what any particular justice is going to morph into once they get that life time tenure and power of being on the highest court in the land, so at the very least pick a genius as Brooks so eloquently points out. Left, right, center, no one really knows because people change and shift once they take that position, so get the smart guy, and hopefully they will be able to figure out what is the proper constitutional interpretation of the law.
